Terms and Conditions

These terms govern use of the Mashwar website and, once publicly launched, the Routine Rides and Shared Trips made available through the app.

Pre-launch status: The website currently provides information before general commercial operation. The finalized legal operator name, registered address, governing-law clause and venue will be inserted before the app begins general commercial operation.

1. Acceptance

By using the Mashwar website or creating an app account after launch, you agree to the terms in force at the time of use. If you do not agree, do not use the service.

2. Eligibility

Mashwar's general service is intended for users aged 18 or older. You must be legally able to undertake the obligations of the service and provide accurate, current information.

3. What Mashwar is

Mashwar is a technology platform that helps drivers and passengers organize Routine Rides and Shared Trips, share available seats and share mobility costs. Unless expressly stated otherwise for a specific service, Mashwar does not own or drive the vehicle used for a trip on behalf of users.

4. Accounts and verification

App use may require an account and verified phone number. You are responsible for accurate account information and for protecting your device and sessions. Mashwar may use additional device, session and account-switching safeguards when enabled to protect the service.

5. Routine Rides

A Routine Ride is a recurring arrangement for defined routes, times and days. It may involve a seat request, driver approval, subscription period, renewal and cancellation according to details shown in the app. A request is not confirmed until the app's required confirmation steps are completed.

6. Shared Trips

A driver may publish an already planned journey with available seats, and passengers may request seats according to the route, time, capacity and conditions shown. Users must not publish fake or misleading trips or use Mashwar for unlawful purposes.

7. Women-only option

When a trip is published as women-only, users must follow the conditions shown for that option. Misrepresenting identity or using the option to evade safety or access requirements is prohibited.

8. Driver responsibilities

  • Provide accurate trip, vehicle and seat information.
  • Meet applicable legal requirements for driving and the vehicle, including any required licence, registration, insurance or permit.
  • Follow agreed route, timing and confirmations as reasonably possible and notify passengers of material changes.
  • Drive safely and do not interact with the platform in a way that distracts from driving.
  • Do not discriminate, harass, threaten or demand undisclosed amounts contrary to agreed trip details.

9. Passenger responsibilities

  • Provide accurate information and request trips you genuinely intend to use.
  • Follow the agreed pickup point and time and notify the driver of material changes.
  • Respect the driver, other passengers and vehicle, and do not carry prohibited or dangerous items.
  • Pay the agreed amount using the payment method shown for the trip.

10. Prices, payments and Mashwar operating fees

The app shows relevant trip or subscription cost information before confirmation. The initial launch is primarily cash-based where shown in the app. Digital payment methods are available only after they are officially enabled and clearly presented. Drivers may owe Mashwar operating fees according to the policy and amount displayed or accepted in the app. Do not send money to an account or method that is not officially presented by Mashwar.

11. Cancellation and no-shows

Cancellation windows and financial or operational consequences vary by ride type and stage. The rules in force are those displayed in the app at booking or acceptance. Repeated abusive cancellations or no-shows may result in account restrictions or administrative review.

12. Prohibited conduct

Fraud, impersonation, harassment, threats, misuse of user data, manipulation of bookings or fees, unlawful content, attempts to compromise the service, and any use that harms users or the platform are prohibited.

13. Safety and emergencies

Users must make reasonable safety decisions and follow applicable law and official instructions. Mashwar is not an emergency service. In an immediate danger situation, contact appropriate local emergency services rather than waiting for Mashwar support.

14. Support, reports and disputes

Report a problem or dispute through the Support page or mashwar.iq@gmail.com. We may request trip-related information or evidence to investigate and take appropriate action.

15. Suspension or termination

Mashwar may restrict, suspend or terminate an account where there is a reasonable safety, fraud, misuse, terms or legal-compliance concern. Users may request account deletion under the Account Deletion page, subject to records that must lawfully be retained.

16. Intellectual property

The Mashwar name, logo, website and app design, content and software are protected by applicable rights. Using the service does not give you the right to copy or commercially exploit the brand or software without permission.

17. Privacy

Personal data is handled under our Privacy Policy.

18. Availability and liability

We aim to provide a reliable service, but interruptions, errors or changes may occur. To the maximum extent allowed by law, Mashwar does not guarantee that a trip will be available, a request will be accepted, another user's conduct will meet expectations, or a particular trip outcome will occur. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

19. Governing law and venue during pre-launch

Before general commercial operation, website use remains subject to mandatory law applicable to the operator and user. This section will be updated with the finalized legal operator, registered address, governing law and agreed venue before the app opens for general commercial operation. This interim wording does not override any mandatory rights provided to users by applicable law.

20. Changes to these terms

We may update these terms when the service, operating rules or legal requirements change. We will show the latest update date and may request renewed in-app acceptance for material changes.
